01What can be registered as a trademark?

A distinctive word, logo, label, device, shape, colour combination or other sign may qualify, subject to representation, distinctiveness, lawful use and the Trade Marks Act and Rules.

02Is a trademark search compulsory?

A search is a critical risk check even though it does not guarantee acceptance. Exact, phonetic, visual, conceptual and related-class conflicts should be reviewed.

03Which form is used for a new application?

A new Indian trademark application is generally filed in Form TM-A for the selected mark and goods or services.

04Can one application cover multiple classes?

A multi-class TM-A can cover more than one class, but official fees apply per class and every class needs an accurate specification.

05Can I use TM after filing?

TM is commonly used to indicate a trademark claim. The registered symbol should be used only after registration for the covered mark and goods or services.

06What happens after examination?

The Registry may accept the application or issue an examination report. A response and hearing may be required before Journal publication.

07How long is the opposition period?

IP India describes a four-month period after Journal publication during which a third party may oppose the application.

08Does registration need renewal?

Yes. A registered trademark has a renewal lifecycle. Current forms, fees, due dates and restoration provisions should be checked before action.
