Entity registration does not grant tax status
A Trust, Society or Section 8 Company is first established under its governing law. Charitable tax registration and donor-deduction approval are separate processes examining objects, activities, accounts and statutory conditions.
Fresh applications changed from April 2026
Income Tax Department guidance states that fresh charitable-organisation applications filed on or after 1 April 2026 are governed by the Income Tax Act, 2025 and use Form 104, corresponding to earlier Form 10A. Existing approvals continue under transition provisions where consistent.
Maintain fund-wise and donor records
Keep books, bank reconciliations, programme expenditure, restricted grants, assets, donation receipts and donor information. Domestic and foreign contribution must not be mixed casually, and anonymous or cash donations can have separate consequences.
Donor approval brings reporting duties
Approval enabling eligible donor deductions is not simply a fundraising badge. The organisation should issue prescribed records or certificates and complete applicable donation statements under current law.
Governance supports every filing
Minutes, trustee or board approvals, conflict registers, related-party controls, budgets and utilisation reports help demonstrate that income and assets serve lawful objects.
Audit, return and renewal conditions must be calendared
Audit forms, income-tax returns, approval validity and renewal or revalidation requirements depend on the current law and organisation facts. Use a current compliance calendar instead of relying on old 12AB articles.
